Authorization for Recurring Payments on Your Eve Financial Credit Card
(“Authorization”)
Authorization for Recurring Payments on the Payment Due Date; Payment Options. You may select one of the three payment options described below, although you are not obligated to arrange for automatic payments and can instead pay by another means. You may change your selection at any time through the credit card mobile app. Changes received at least three business days prior to your next Payment Due Date, will be effective for that Payment Due Date.
Option 1: Minimum Payment Due: By selecting this option, you authorize us (which includes for the purposes of this Authorization First Pryority Bank, Eve Financial and any other service providers of First Pryority Bank) to initiate recurring electronic debits to the debit card and/or deposit account that you provide to us when you enroll in automatic payments through the mobile app and any substitute debit card or deposit account you or your financial institution may later provide to us (the “Debit Card/Deposit Account”) in the amount of your Minimum Payment Due or the outstanding balance of your Account as of the Payment Due Date (the “Current Balance”), whichever is less. We will initiate each debit on or after the Payment Due Date.
Option 2: Statement Balance: By selecting this option, you authorize us to initiate recurring debits to your Debit Card/Deposit Account in the amount of the New Balance shown on your most recent Statement, adjusted for any payments and credits that post between the statement date and the Payment Due Date (the “Statement Balance”) or the Current Balance, whichever is less. We will initiate each debit on or after the Payment Due Date.
Option 3: Current Balance: By selecting this option, you authorize us to initiate recurring debits to your Debit Card/Deposit Account in the amount of the Current Balance as of the Payment Due Date (which will include any transactions that post in between the date of your most recent statement and the Payment Due Date). We will initiate each debit on or after the Payment Due Date.
Option 4: “Stay Ahead”: By selecting this option, you authorize us to initiate recurring debits to your Debit Card/Deposit Account in the amount of the “Stay Ahead” balance, which is calculated by splitting all transaction into equal monthly payments across the total number of Payment Due Dates before the transaction begins accruing interest. Example: if you spend $400 in a given month and these transactions qualify for four months of 0% APR according to the terms in the Cardmember Agreement, your “Stay Ahead” calculation would equal $100 per month, assuming no other purchase balances.
Authorization to Vary Amounts. You understand that you have the right to receive notice in advance of any recurring debit that varies from the amount authorized above or a prior amount. To receive notice of all varying debit amounts, you may write to us at First Pryority Bank c/o Eve Financial at 2701 N. Thanksgiving Way #100, Lehi, Utah 84043. Unless you elect to receive advance notice, you agree that we need not provide written notice if the amount of a recurring debit is less than the amount authorized above or no more than such amount plus any unpaid amounts, fees or charges then due in accordance with the Cardmember Agreement. If a recurring debit will vary by more than these amounts, we will send you notice at least ten (10) days in advance of the debit.
Authorization to Debit Additional Payments You Authorize. You authorize us to initiate debits to the Debit Card/Deposit Account in any amount and on any date that you subsequently direct by phone, email or other method we make available.
Authorization to Correct Errors, Initiate Credits and Verify or Update Account Information. In the event we make an error in processing a debit, you authorize us to correct the error by initiating a credit or debit to the Debit Card/Deposit Account in the amount of such error on or after the date such error occurs. You authorize us to credit your Debit Card/Deposit Account, as necessary, to obtain an accurate balance under your Cardmember Agreement (e.g., you have a credit balance on your loan due to return of the goods and services you have purchased, portions of order are canceled by merchant, or other refunds are owed to you). You authorize us to verify any Debit Card/Deposit Account information you provide, including via an authorization request, non-monetary entry or similar entry to the Debit Card/Deposit Account and/or to obtain Debit Card/Deposit Account information from your applicable financial institution. If there is any missing or erroneous information with respect to the Debit Card/Deposit Account or the associated financial institution, you authorize us to verify and correct such information.
Reinitiating Rejected Debits. Unless otherwise limited by law, if any debit under this Authorization is rejected or otherwise returned unpaid, you authorize us to reinitiate it up to two additional times or any greater number of times permitted by applicable network rules. However, you agree that we are under no obligation to reinitiate any rejected charges or debits. You understand that your financial institution may impose fees in connection with rejected debits, and you agree that we do not have any liability to you for such fees. If you believe a payment will be rejected by your financial institution (e.g., because there is not enough money in/on your Debit Card/Deposit Account), you should contact us to make alternate payment arrangements.
Revocation and Termination. You can revoke this Authorization by contacting customer service through one of the methods specified on the Eve Financial website at www.evefinancial.com or calling us at (855) 383-1331, Monday-Friday from 8:00 AM – 6:00 PM Mountain Time. Any notice of revocation and termination must be received AT LEAST THREE (3) BUSINESS DAYS PRIOR TO THE NEXT SCHEDULED PAYMENT to avoid the next scheduled debit from being automatically initiated. We may terminate your enrollment in recurring electronic payments at any time for any reason. If you or we terminate this Authorization, you understand that you will be responsible for making your payments by another payment method. Terminating this Authorization does not affect your duty to repay amounts due under your Cardmember Agreement. This Authorization in no way limits any right you may have to stop payment of a preauthorized electronic transfer or other payment method by contacting your financial institution.
Miscellaneous. You promise that the Debit Card/Deposit Account is legitimate, open and active and that you are an authorized user on such account(s). You understand that this Authorization is subject to applicable law and network rules. Each payment will be processed in U.S. dollars, and, if it is converted into another currency, its amount may vary based on fluctuations in the applicable conversion rate. This Authorization supplements your Cardmember Agreement.
BY AGREEING TO AUTOMATIC PAYMENTS AND CONTINUING, YOU ARE ELECTRONICALLY SIGNING AND AGREEING TO THIS AUTHORIZATION TO ELECTRONICALLY DEBIT YOUR DEBIT CARD/DEPOSIT ACCOUNT ON A RECURRING BASIS. YOU ACKNOWLEDGE THAT YOU HAVE READ, SAVED, UNDERSTAND, AND AGREE TO BE BOUND BY THE TERMS OF THIS AUTHORIZATION. WE WILL EMAIL YOU A COPY OF THIS AUTHORIZATION TO YOUR SPECIFIED EMAIL ADDRESS AFTER YOU ELECTRONICALLY SIGN IT. IF YOU DO NOT WISH TO MAKE AUTOMATIC RECURRING PAYMENTS, YOU SHOULD CLOSE THIS BROWSER SESSION OR THE APP.
