1. About this Policy

Eve Financial, Inc. (“Eve,” “we,” “us,” or “our”) operates a point-of-sale financing marketplace. When you request financing through a participating merchant, we route your request to third-party lenders, and each lender decides whether to make you an offer.

Eve is not a lender. We do not make credit decisions, set rates or terms, fund loans, hold loans, service loans, accept payments from you, or collect debts. Those activities belong to the lender you choose.

This Policy explains how we collect, use, and share personal information through our websites and services (together, the “Services”). It applies to consumers who request financing, visitors to our websites, personnel at the merchants who use our platform, and job applicants who apply to work at Eve.

Eve Financial, Inc. is a single company. We have no parent company, subsidiaries, or affiliates, so nothing in this Policy involves sharing information with affiliated companies.

3. Information we collect

Information you give us. When you request financing, you provide information through our application. This may include your name, mailing address, email address, telephone number, date of birth, Social Security number, income, and employment information.

Information from merchants. To send you a financing link, a participating merchant gives us your telephone number and the amount of the proposed transaction. Merchants do not enter the rest of your application information; you enter it yourself.

Information from lenders and consumer reporting agencies. In connection with prequalification, we may receive information about your eligibility for financing, including prequalification results, offers, decisions, and funding status.

Information collected automatically. When you visit our websites, we collect technical information such as your IP address, browser and device type, operating system, referring pages, and the pages you view.

Job applicants. If you apply for a job with Eve, we collect the information in your application and materials, and information from recruiters, references, and background check providers where permitted by law.

4. How we use information

We use personal information to:

• present financing options and route your request to lenders;
• verify your identity and help prevent fraud;
• communicate with you about your request and our Services;
• operate, maintain, secure, and improve the Services;
• administer our relationships with merchants and lenders; and
• comply with applicable law and enforce our agreements.

We do not use your information to make credit decisions, because we do not make them.

We share personal information:

• With lenders. We transmit your financing request to lenders in our network so they can decide whether to make you an offer. Each lender's use of your information is governed by that lender's own privacy notice.
• With the merchant. We share the status of your financing request with the merchant where you are making your purchase.
• With service providers. We share information with companies that perform services for us, such as hosting, communications, identity verification, fraud prevention, analytics, and customer support, under contracts that require them to protect the information and use it only on our behalf.
• For legal and safety reasons. We share information where we believe disclosure is required by law or legal process, or is necessary to prevent fraud, protect our rights or the rights of others, or respond to a lawful request from a government authority or regulator.
• In a business transaction. If Eve is involved in a merger, acquisition, financing, or sale of assets, we may transfer information as part of that transaction.

We do not sell personal information, and we do not share personal information for cross-context behavioral advertising or targeted advertising. Eve does not conduct consumer advertising and does not participate in interest-based advertising networks.

6. Cookies and analytics

Cookies are small text files placed on your device by a website. We use cookies that are necessary for our websites to function and cookies that help us understand how visitors use them, including Google Analytics. We do not use cookies or pixels for advertising. Most browsers allow you to refuse or delete cookies through their settings, though parts of our websites may not work properly if you do.

7. Communications

Your consent to receive documents and communications from us electronically is governed by our Electronic Communications Consent, available at eve.co/legal/electronic-communications.

If you opt in to receive text messages from Eve, we may send you messages relating to your financing request, including status updates, disclosures, and reminders. Message frequency varies. If you communicate with us by telephone, we may monitor or record the call.

8. How we protect information

We maintain an information security program with administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, and disclosure. No system is completely secure. If you believe your personal information has been disclosed without authorization, contact us at privacy@eve.co.

9. How long we keep information

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including to process financing requests, comply with legal and recordkeeping obligations, resolve disputes, and enforce our agreements. We maintain retention schedules and dispose of information securely when it is no longer required.

10. Your choices and rights

Depending on where you live, you may have the right to know what personal information we hold about you, to access, correct, delete, or obtain a copy of it, to opt out of the sale or sharing of personal information or of targeted advertising, and not to be treated differently for exercising these rights. As described in Section 5, we do not sell or share personal information for advertising purposes.

To make a request, email privacy@eve.co. We will take steps to verify your identity before we respond, and we may ask you for information necessary to do so. You may use an authorized agent where the law permits.

Most of the information we collect is subject to the Gramm-Leach-Bliley Act and is exempt from these state privacy laws. Where an exemption applies to your request, we will tell you in our response. We will not disclose Social Security numbers, government identification numbers, financial account numbers, or account credentials in response to an access request.

Correcting your credit report. Information about your creditworthiness is maintained by the consumer reporting agencies, not by Eve. To dispute information in your credit report, contact Experian, TransUnion, or Equifax directly.

Vermont residents. We do not share nonpublic personal financial information about Vermont residents with nonaffiliated third parties except as permitted by law.

11. Children

Our Services are intended for adults. We do not knowingly collect personal information from anyone under 18, and our Services are not directed to children. If you believe a child has provided us with personal information, contact us at privacy@eve.co, and we will delete it.

12. Changes to this Policy

We may revise this Policy from time to time. Changes take effect when we post the revised Policy with an updated “Last Updated” date. Where the law requires it, we will provide advance notice of material changes.
